Patented cloning methods

I just realized this morning that the two methods we were using for cloning in the Open Insulin project are in fact patented.

Golden gate :EP2580332B1 - System and method of modular cloning - Google Patents

Gibson Assembly : US9593329B2 - Assembly of large nucleic acids - Google Patents

I was wondering if some people already look into it and what it mean if we use these methods to assemble plasmid to express proteins for commercial purposes or if we want to share the plasmid with an openMTA which allow a commercial purpose.

We have used TIIS-based assembly using the Reclone Syntax for our Open DNA Collections, and I believe we were under the impression that using these process should be fine?

But perhaps @jenny_molloy may be able to give more insight on the IP side of things?

yes you are right, the golden gate is prior art. I got confused by the patent title, but the patent is only about the DNA sequences used.
I was using the gibson assembly for my project, and this method is definitively under patent, so I will move to the golden gate assembly and used the open yeast collection.
